4A. Case Management Reviews (CMR)

What is a Case Management Review?

A Case Management Review (CMR) is a short hearing, usually lasting around 30 minutes where an Immigration Judge will identify the key issues of the appeal and give directions about any additional information needed at the full hearing.

How will I know what to take to the CMR?

We will write to tell you the date and the place for the CMR and advise you about what you should take with you and what will happen at the hearing.

Can the Home Office (the Respondent) be directed to provide more information?

Yes. The judge can direct either you (the Appellant) or the Home Office (the Respondent) to provide more information.

Will the Judge make a decision at the CMR?

If you or the Home Office do not attend the CMR and have not complied with requirements or directions that were correctly served the Immigration Judge could determine the appeal in your absence

I am the appellant. Do I need to attend the CMR hearing?

If you live in the UK and do not have a representative, you should attend the first hearing (CMR). Although the CMR is not a full hearing the Immigration Judge could allow or dismiss your appeal at that stage. It is important that you attend or are represented. If you or your representative does not attend the CMR, the Immigration Judge may decide your appeal in your absence.

I am the appellant's representative. Do I need to attend the CMR?

You should either attend the CMR or explain your absence in writing in advance of that hearing by writing as soon as possible to the Immigration Judge at the Hearing Centre where the CMR is scheduled to be heard. Your letter should clearly state the reasons why you cannot attend.

Although the CMR is not a full hearing the Immigration Judge could allow or dismiss the appeal at this stage. It is important that the Appellant attends or is represented. If you or the appellant do not attend the CMR, the Immigration Judge may decide the appeal in your absence.

Can I have the case management review hearing adjourned?

The CMR will only be adjourned in exceptional circumstances. An Immigration Judge will decide any application for adjournment. If you wish to request an adjournment you must write as soon as possible to the Immigration Judge at the Hearing Centre where the CMR is scheduled to be heard. Your letter should clearly state the reasons why you want the hearing adjourned. You will have been provided with details of the hearing centre. Details of the hearing centres.

Can I have the case management hearing transferred to another hearing centre?

The CMR will only be transferred in exceptional cases. An Immigration Judge will decide on applications to have the case transferred. If you wish to request a transfer to another Hearing Centre, you must write as soon as possible to the Immigration Judge at the Hearing Centre where the appeal is scheduled to be heard. Your letter must clearly state the reasons for your request.

I don't speak English. Will an interpreter be provided?

Please tell us immediately if you need an interpreter and the language and dialect that you speak. You are able to do this on your appeal form. An interpreter will be provided free of charge to interpret for you at the full hearing. If you do not have a representative an interpreter will also be booked if there is a Case Management Review.

If you need an interpreter and have not said so on your appeal you must write/fax your request for an interpreter to AIT Arnhem Support Centre, PO Box 6987, Leicester, LE1 6ZX at least 5 days before the hearing.
